In the near future, students will continue to move across borders more frequently than ever before. It will be increasingly common for Canadian students to attend school in the United States, whether for a semester, a year, or an entire program. Even when these students relocate, one important fact will remain: their personal information will still be protected under Canadian privacy law.

For this reason, understanding and complying with PIPEDA—the Personal Information Protection and Electronic Documents Act—will be an essential part of protecting Canadian students who attend school in the U.S. School Contact will commit to meeting these responsibilities while also complying fully with U.S. federal, state, and local laws. As our vision expands to Canada and Mexico, we will design our system to respect privacy obligations across borders from the very beginning.


PIPEDA Will Follow Canadian Residents Wherever They Go

PIPEDA will continue to apply to the personal information of Canadian residents, even when they are physically located outside Canada. This means that if a Canadian student uses an educational communication platform while living in the United States, that platform will still have obligations under Canadian law.

Location will not remove a student’s privacy rights. If a service collects or stores personal information such as a student’s name, communication identifier, school affiliation, or academic-related data, PIPEDA’s requirements will still apply.

In short, Canadian students in the U.S. will still have Canadian privacy protections. School Contact will be designed to uphold these rights.


Why PIPEDA Will Matter in Future School Communication Systems

Schools and districts will continue to rely on communication platforms to support learning and keep families informed. When Canadian students participate in these systems, several responsibilities will arise:

Meaningful Consent

Parents and guardians will need to be informed about what information is collected, why it is collected, where it will be stored, and who will be able to access it. These disclosures will be especially important when the student is a minor.

Data Minimization

Platforms will need to collect only the information necessary for the service to function. There will be no place for unnecessary data gathering, tracking, or profiling.

Transparency About Cross-Border Data Handling

If student information will be stored or processed in the United States, families will need to be informed. Organizations will need to explain what protections will be in place and how cross-border data flows will be safeguarded.

Access and Correction Rights

Canadian families will have the right to request copies of their personal information or ask for corrections, regardless of where the student attends school.

Safeguards for Sensitive Data

When minors are involved, privacy rules must be applied with exceptional care. Communication identifiers, directories, and student-role information will need strong security and careful handling.

A System That Will Be Designed for Cross-Border Education

Educational mobility will continue to increase. Students will move between provinces and states, switch school systems, or live between two nations as their families relocate. Communication systems that support them will need to be designed with this international reality in mind.

Although PIPEDA is a Canadian law, School Contact will be committed to making our proposal as safe and compliant as possible for all students. That commitment will include working within local, state, and federal laws in the United States, as well as meeting the privacy expectations of Canada—and eventually Mexico—as our proposals expand across North America.
